Welcome to FJ Virtual Scholars. By accessing or using our website, enrolling in our programs, or otherwise using our services ("Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing our website, enrolling in a program, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

We reserve the right to modify these Terms at any time. Continued use of our Services after changes constitutes acceptance of the updated Terms.

2. Eligibility and Account Responsibility

To enroll in our programs, you must:

• Be at least 18 years of age or have parental/guardian consent
• Provide accurate and complete information during enrollment
• Maintain the confidentiality of your account credentials
• Be responsible for all activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account or any security breach.

3. Use of Services

You agree to use our Services for lawful purposes only and in compliance with all applicable laws and regulations. You may not:

• Engage in unauthorized access, copying, or distribution of our course materials or content
• Share your account credentials with others or allow unauthorized access
• Disrupt, compromise, or attempt to bypass the security or functionality of our website or systems
• Use automated systems (bots, scrapers) to access our Services without permission
• Engage in fraudulent, harmful, harassing, or misleading activity
• Impersonate another person or entity
• Upload or transmit viruses, malware, or other harmful code

4. Intellectual Property Rights

All content provided through our Services, including but not limited to:

• Course materials, videos, worksheets, and lesson plans
• Website design, graphics, logos, and branding
• Text, images, audio, and video content
• Software and technology infrastructure

Course materials are provided solely for your personal, non-commercial educational use during your enrollment period.

5. Enrollment, Payments, and Refunds

5.1 Enrollment

Enrollment in our programs is subject to availability and acceptance. We reserve the right to refuse enrollment or cancel enrollment at our discretion.

5.2 Payment Terms

• All fees must be paid in full before or at the time of enrollment unless a payment plan is explicitly agreed upon
• Prices are subject to change at any time, but enrolled students will not be affected by price increases during their enrollment period
• Employer-sponsored enrollments follow separate invoicing and payment terms as agreed

5.3 Refund Policy

Our refund policy is as follows:

• Full Refund: Requests made within 7 days of enrollment and before attending the first live class
• Partial Refund: After the first week, refunds are prorated based on the number of classes attended
• No Refund: After 50% of the program has been completed (5 weeks for a 10-week program)
• Employer-Sponsored: Refund terms follow the employer agreement

To request a refund, contact us at info@fjvirtualscholars.com within the applicable timeframe. Refunds are processed within 10-14 business days.

6. Student Conduct and Expectations

As a student, you are expected to:

• Attend scheduled live classes or watch recordings promptly
• Complete assignments and participate actively in coursework
• Treat instructors and fellow students with respect and professionalism
• Follow instructor guidance and program requirements
• Use technology responsibly during virtual classes (mute when not speaking, appropriate backgrounds, etc.)

We reserve the right to remove students from programs for disruptive behavior, harassment, academic dishonesty, or violation of these Terms, without refund.

7. Program Modifications and Cancellations

FJ Virtual Scholars reserves the right to:

• Modify course content, schedules, or instructors as needed
• Cancel or postpone cohorts due to low enrollment or unforeseen circumstances
• Discontinue programs or features at our discretion

In the event of a cancellation by FJ Virtual Scholars, enrolled students will receive a full refund or the option to transfer to a future cohort.

8. Certificates and Credentials

Upon successful completion of a program (attendance of at least 80% of classes and completion of required assignments), you will receive a Certificate of Completion from FJ Virtual Scholars.

9. Third-Party Services

Our Services may integrate with or link to third-party platforms including:

• Video conferencing (Zoom)
• Payment processors
• Scheduling tools
• Learning management systems

We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their own terms and conditions.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you also consent to the practices described in the Privacy Policy.

11. Disclaimers and Limitations of Liability

11.1 No Guarantees

While we strive to provide high-quality educational services, we make no guarantees regarding:

• Specific learning outcomes or test scores
• Job placement or career advancement
• Passing of any external exams (GED, HiSET, etc.)
• Accuracy or completeness of all content

11.2 Services Provided "As Is"

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.3 Limitation of Liability

In no event shall our total liability to you for all claims exceed the amount you paid to FJ Virtual Scholars in the six months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless FJ Virtual Scholars and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of these Terms
• Your use or misuse of our Services
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to conflict-of-law principles.

13.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of our Services, the parties agree to first attempt to resolve the dispute through good-faith negotiation.

If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, or in the state or federal courts located in Indiana.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Disruptive behavior or harassment
• Non-payment of fees

Upon termination, your right to use the Services will immediately cease, and we may delete your account and associated data.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FJ Virtual Scholars regarding the use of our Services and supersede any prior agreements.
